U.S.-Peru FTA's Investor-State System Expands on CAFTA's Definition of Government Activities Subject to "Regulatory Takings" Claims
This article from Public Citizen states that the Peru agreement has been changed only slightly from CAFTA's model, mainly by extending the definition of investment subject to investor-state enforcement, expanding foreign investors rights to control sensitive infrastructure, giving foreign investors greater rights in violation of Congress' demands, and further extends the definitions of investment and expropriation. It also violates Congress' demands for greater transparency.
